Background

Administrative rules for Large Onsite Sewage Systems (“LOSS”) are contained in Chapter 246-272B WAC.  In January 2004, based on recommendations of our Onsite Advisory Committee, the Department of Health (DOH) began the process of revising those rules.

A LOSS Rule Development Committee (“LRDC”) consisting of stakeholders representing various sectors of private industry, state, and local agencies was convened to develop a prioritized list of issues to be addressed. The LRDC met a number of times between February 2004 and October 2005 and agreed upon revised rule language addressing some (but not all) of the issues on the original list.  The intent was to complete the LOSS rule revision before July 1, 2007, when Chapter 246-272A WAC,  a new state rule for on-site sewage systems with design flows less than 3500 gallons per day (GPD), came into effect.  Personnel changes and resource issues caused the rule revision process to be temporarily suspended in late 2005, and the goal was not met.

In April 2007 the legislature passed Senate Bill 5894, which was signed by Governor Gregoire and codified as RCW 70.118B. The new statute expands DOH authority to approve LOSS with design flows up to 100,000 GPD, and requires us to issue operating permits and develop standards for all newly-defined LOSS by July 1, 2009.  This new requirement caused us to modify our rule revision strategy.  We are including the new requirements with the other proposed changes to the rule, and are asking a new LOSS Rule Advisory Committee (LOSS RAC) to help us with this process.
